Corné van der Stelt fotografie
1. Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op alle fotografie-opdrachten uitgevoerd door Corné van der Stelt, tenzij schriftelijk anders overeengekomen.
2. Offertes en overeenkomsten
Een offerte is vrijblijvend en geldig gedurende 30 dagen.
Een opdracht komt tot stand na schriftelijke bevestiging per mail of overeenkomst.
3. Uitvoering van de opdracht
De fotograaf voert de opdracht naar beste inzicht, vakmanschap en creatieve visie uit.
De opdrachtgever erkent dat fotografie een creatief proces is en dat het eindresultaat niet exact vooraf kan worden gegarandeerd.
4. Planning en voorbereiding
De opdrachtgever draagt zorg voor tijdige aanlevering van alle noodzakelijke informatie, toegang tot locaties en aanwezigheid van betrokkenen.
Eventuele vertraging of extra kosten door incomplete voorbereiding kunnen worden doorbelast.
5. Levering en selectie
De fotograaf maakt een selectie van de beelden die aan de opdrachtgever wordt geleverd.
Ruwe bestanden (RAW) worden in principe niet verstrekt, tenzij schriftelijk anders overeengekomen.
6. Nabewerking
De stijl van nabewerking is onderdeel van de signatuur van de fotograaf.
Binnen de overeengekomen opdracht zijn twee correctierondes inbegrepen tijdens het nabewerkingsproces.
Indien er meer correctierondes of aanvullende aanpassingen worden gevraagd, kunnen deze aanvullend worden gefactureerd op basis van het geldende uurtarief of een vooraf overeengekomen bedrag.
7. Auteursrecht en gebruik
Het auteursrecht op alle gemaakte beelden berust te allen tijde bij de fotograaf.
De opdrachtgever verkrijgt een gebruikslicentie zoals overeengekomen in de offerte.
Gebruik buiten deze licentie vereist voorafgaande schriftelijke toestemming.
8. Gebruik door derden
Het is niet toegestaan beelden door te leveren aan derden, zoals partners, bureaus of media, zonder aanvullende licentie.
9. Gebruik in digitale en gegenereerde toepassingen
Gebruik van fotografie voor digitale compositing, automatisering, AI-training, generatieve toepassingen of vergelijkbare technologieën valt buiten standaard gebruiksrechten en vereist een aanvullende licentie.
10. Naamsvermelding
Bij publicatie dient, indien redelijk mogelijk, de naam van de fotograaf te worden vermeld.
11. Facturatie en betaling
Facturen dienen binnen 14 dagen na factuurdatum te worden voldaan.
De fotograaf behoudt zich het recht voor om voorafgaand aan de uitvoering van de opdracht een aanbetaling van 50% van het overeengekomen bedrag te factureren.
Het resterende bedrag wordt na uitvoering van de opdracht gefactureerd, tenzij schriftelijk anders overeengekomen.
Bij overschrijding van de betalingstermijn is wettelijke rente verschuldigd.
12. Annulering
Bij annulering binnen 7 dagen voor de geplande shoot kan 50% van het overeengekomen bedrag worden gefactureerd.
Bij annulering binnen 48 uur kan 100% worden gefactureerd.
13. Aansprakelijkheid
De aansprakelijkheid van de fotograaf is beperkt tot het factuurbedrag van de betreffende opdracht.
De fotograaf is niet aansprakelijk voor indirecte schade of gevolgschade.
14. Overmacht
In geval van overmacht, zoals ziekte, extreme weersomstandigheden of technische storingen, wordt in overleg een nieuwe datum gepland.
15. Archivering
Beelden worden door de fotograaf minimaal 6 maanden bewaard.
Daarna kan geen garantie op beschikbaarheid worden gegeven.
16. Toepasselijk recht
Op alle overeenkomsten is Nederlands recht van toepassing.

1. Applicability
These general terms and conditions apply to all photography assignments carried out by Corné van der Stelt, unless otherwise agreed in writing.
2. Quotations and Agreements
All quotations are non-binding and valid for 30 days.
An assignment becomes effective upon written confirmation via email or formal agreement.
3. Execution of the Assignment
The photographer will execute the assignment to the best of their professional ability, craftsmanship, and creative vision.
The client acknowledges that photography is a creative process and that the final result cannot be guaranteed in advance.
4. Planning and Preparation
The client is responsible for the timely provision of all necessary information, access to locations, and availability of involved parties.
Any delays or additional costs resulting from incomplete preparation may be charged to the client.
5. Delivery and Selection
The photographer will make a selection of images to be delivered to the client.
Raw files (RAW) will not be provided unless otherwise agreed in writing.
6. Post-production
The editing style is part of the photographer’s artistic signature.
Two revision rounds are included within the agreed assignment during the post-production process.
Any additional revisions or requested adjustments may be invoiced separately based on the applicable hourly rate or a pre-agreed fee.
7. Copyright and Usage
Copyright of all images remains at all times with the photographer.
The client is granted a usage license as specified in the quotation.
Any usage beyond this license requires prior written consent.
8. Use by Third Parties
The client is not permitted to supply images to third parties, such as partners, agencies, or media, without an additional license.
9. Use in Digital and Generated Applications
Use of photography for digital compositing, automation, AI training, generative applications, or comparable technologies falls outside standard usage rights and requires an additional license.
10. Credit
Where reasonably possible, the photographer’s name must be credited upon publication.
11. Invoicing and Payment
Invoices must be paid within 14 days from the invoice date.
The photographer reserves the right to invoice a 50% advance payment prior to the execution of the assignment.
The remaining balance will be invoiced after completion of the assignment, unless otherwise agreed in writing.
In case of late payment, statutory interest will be charged.
12. Cancellation
In case of cancellation within 7 days prior to the scheduled shoot, 50% of the agreed fee may be charged.
In case of cancellation within 48 hours, 100% may be charged.
13. Liability
The photographer’s liability is limited to the invoice amount of the relevant assignment.
The photographer is not liable for indirect or consequential damages.
14. Force Majeure
In case of force majeure, such as illness, extreme weather conditions, or technical failure, a new date will be scheduled in mutual consultation.
15. Archiving
Images will be archived by the photographer for a minimum of 6 months.
After this period, availability cannot be guaranteed.
16. Governing Law
All agreements are governed by Dutch law.
